CQC Variation Application: Add Supported Living in 2026

Last checked against Care Quality Commission guidance: 14 October 2026

A CQC variation application may be needed when an existing provider adds a regulated activity, opens a new location or asks the Care Quality Commission (CQC) to remove a condition. Adding supported living is different because supported living is a service model, not a regulated activity in its own right. CQC regulates the personal care delivered within the service, not the housing.

If you already hold personal care at the correct location, a CQC variation application may not be needed; the change may only require an updated Statement of Purpose and a notification. If you need a new activity, a new office or removal of a learning disability and autism condition, you need the correct formal application before the change takes effect. The route depends on the exact wording of your current certificate.

Is Supported Living a Regulated Activity?

Supported living is not one of the regulated activities listed in Schedule 1 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014. The regulated activity most often involved is personal care.

Personal care includes physical assistance with washing, dressing, eating, drinking, toileting and related personal hygiene. It can also include prompting and supervision where a person cannot make the relevant decision without support because of age, illness or disability. The precise legal scope includes qualifications and exceptions, so compare your planned work with the CQC scope of registration guidance.

CQC’s location guidance explains that a supported living location is normally the office from which care is coordinated. The individual homes where people live are not usually registered locations. This is why adding supported living can involve three separate questions:

  1. Do you already hold personal care?
  2. Is the managing office already on your certificate for that activity?
  3. Does your certificate contain a condition restricting specialist services for autistic people or people with a learning disability?

The answers determine whether you need a notification, an application or both.

Which CQC Change Route Applies?

For a CQC variation application, the safest route is the one that matches your certificate, activity, location and service user bands. The table below gives a practical starting point.

Your proposed changeLikely routeRegistered manager action
Add supported living from an existing office already registered for personal careUpdate the Statement of Purpose and notify CQC, subject to certificate conditions and confirmation from CQCMake sure the manager’s responsibilities and time allocation remain accurate
Add supported living from a new officeApply to add a location and update the Statement of PurposeExisting manager applies to add the location, or a new manager applies to register
Add personal care when you do not already hold itSubmit a CQC variation application to add the regulated activityManager adds the activity to their registration, or a new manager applies
Add another regulated activity you do not holdSubmit a separate application for each new activitySubmit the matching manager application where required
Start a specialist service for autistic people or people with a learning disability where a restrictive condition appliesApply to vary or remove the condition and provide the additional evidence CQC requestsManager arrangements and capability must match the proposed service
Move the office that appears as a registered locationApply to remove the old location and add the new locationManager submits matching location applications

A CQC variation application is not a decision on your registration; this is general guidance. If the service model is unusual or the certificate wording is unclear, use CQC’s pre-application advice before committing to a start date.

Three CQC change routes start from the activity, location and conditions already on the certificate.

How to Add Supported Living to CQC Registration

If you already hold personal care at the office that will manage the supported living service, a CQC variation application may not be needed to add another regulated activity. CQC says a provider can operate more than one service from the same location without a variation when it is already registered for each relevant activity at that address.

CQC’s published example concerns more than one domiciliary care service. It does not state the supported living scenario in the same words. Our interpretation is that an existing personal care provider may add supported living from the same registered office by updating its Statement of Purpose and notifying CQC, provided no registration condition prevents the proposed specialist service. Confirm that route with CQC before care starts.

Your preparation should still cover the supported living model in full. Update the service description, people supported, staffing, training, governance and manager arrangements. Your policies and contracts should reflect a tenancy based service rather than treating the new service as ordinary homecare with a different label.

Providers starting from scratch should follow the new provider route instead. The supporting documents and readiness requirements for a first registration are wider than a notification by an existing provider.

Check the Learning Disability and Autism Condition

Before preparing a CQC variation application, read every condition on your CQC certificate, particularly when planning a supported living service for autistic people or people with a learning disability.

CQC says that applications received from 1 September 2022 can carry a routine condition where the provider did not intend to provide a specialist learning disability or autism service and applied for certain activities, including personal care. The condition prevents the location from providing a specialist service where the person’s need for care or treatment is a direct result of learning disability or autism.

If that condition appears on your certificate, you cannot remove it by changing a service user band or sending only a Statement of Purpose notification. You must apply to vary or remove the condition. CQC will assess how the proposed service meets its statutory guidance, Right support, right care, right culture.

Prepare evidence covering:

  • how people will exercise choice and control
  • how the service promotes community participation and ordinary living
  • the size, design and location of the proposed service
  • staff competence in learning disability and autism support
  • positive behaviour support and any use of restraint
  • governance, safeguarding and quality monitoring

CQC encourages providers planning these services to use its pre-application process. That conversation can help clarify the correct application route before you invest in premises or agree a contract start date.

How to Add a New Regulated Activity

A CQC variation application to add an activity is required when your provider registration does not already include that activity. CQC requires a separate application for each new regulated activity.

Use this sequence:

  1. Check the activity against Schedule 1 and CQC’s scope guidance.
  2. Confirm that the activity is not already on your certificate.
  3. Download the current provider form from the relevant CQC page.
  4. Complete the section for every existing and new location involved.
  5. Add any extra location or nominated individual forms the page requires.
  6. Update the Statement of Purpose so it describes the new activity accurately.
  7. Prepare the matching registered manager application.
  8. Submit all connected forms together using the route stated by CQC.
  9. Apply at least 10 weeks before the proposed start date.
  10. Wait for written approval and an updated registration before providing the activity.

When completing a CQC variation application, use the current form. The CQC add a regulated activity page says applications made on old forms will be returned. It also says most rejected applications contain incorrect provider or location details. Copy the legal name, provider ID, location ID, addresses and conditions directly from the certificate rather than relying on memory.

How to Add or Move a CQC Location

A CQC variation application to add a location is normally required when your supported living service will be managed from a new office. CQC lists registered locations as conditions of registration, so do not operate from the new office before approval.

For supported living, the location is usually the office that coordinates the care. It is not each person’s home. CQC’s guidance on what counts as a location explains the exceptions, including situations where a genuinely separate office is based within a supported living property.

Use the current provider application to add a location. Complete the extra location section for every additional location. If the proposed service is for autistic people or people with a learning disability, follow the questions and additional evidence route carefully.

Moving an office is not a simple address edit where the operational location changes. CQC says the provider and manager should apply to remove the old location and add the new one, with all related applications sent together. The move must not take effect until CQC has granted it.

Provider and manager applications must describe the same activities and locations.

What the Registered Manager Must Do

The provider’s CQC variation application and the manager’s application are separate. A change to the provider certificate does not automatically change the registered manager’s registration.

If an existing manager will manage the new activity or location, they need the matching manager application. If a new person will manage the service, that person applies as a new registered manager. CQC may link the applications and assess them together.

Check these details side by side before submission:

Effective dateRealistic proposed dateSame proposed dateService timeline agrees
People supportedCorrect service user bandsManager experience fits the groupNeeds and specialisms are clear
Management capacityGovernance structure describedHours and responsibilities explainedTime split across locations is visible

CQC says managers can be registered for more than one location if they can show they can manage them effectively. Explain travel time, service size, staffing structure, on-call arrangements, delegated responsibilities and management cover. A title on an organisation chart is not enough evidence of capacity.

Update Your Statement of Purpose

The Statement of Purpose should connect every part of the CQC variation application. Under Regulation 12 of the Care Quality Commission (Registration) Regulations 2009, a registered person must keep it under review and send CQC written details of a revision within 28 days.

When adding supported living, review at least:

  • service types delivered from each location
  • regulated activities and the people they apply to
  • service user bands and the range of needs supported
  • aims and objectives for the new service
  • registered manager arrangements and time split
  • housing and care separation
  • complaints, involvement and accessible communication
  • location and contact information

If the change requires a formal application, include the updated Statement of Purpose with that application where CQC asks for it. For a notification only change, use the current change to a Statement of Purpose notification and include the revised document.

Our practical Statement of Purpose guide explains how to keep activities, locations, needs and leadership arrangements consistent.

Keep Housing and Care Genuinely Separate

Supported living should preserve the person’s control over their home. CQC regulates the care, whilst the accommodation sits outside CQC’s regulated activity unless the overall arrangement amounts to accommodation with personal care.

Evidence should show that:

  • the tenancy or occupancy arrangement is separate from the care contract
  • the person can choose or change their care provider without automatically losing their home
  • the person has meaningful control over their private space and daily life
  • housing decisions are not controlled through the care agreement
  • staff treat the property as the person’s home

If accommodation and care operate as one inseparable package, the model may fall within the care home regulated activity instead. CQC’s housing with care guidance explains the factors used to distinguish the models.

Supported living should protect a person’s control over their home and care choices.

Prepare the Evidence Behind the Application

The CQC variation application form is only the front of the change. CQC may ask how the new service will work safely and how the organisation will maintain oversight.

Build an evidence pack that includes:

EvidenceWhat it should demonstrate
Current certificateThe exact provider, activities, locations and conditions in force
Updated Statement of PurposeOne accurate description of the revised service
Supported living policiesTenancy based care, rights, choice and operational practice
Training planRole specific induction, mandatory learning and specialist skills
Service user guideAccessible information written for the people using the service
Tenancy and care contract templatesGenuine separation between housing and personal care
Manager capacity planTime, travel, delegated responsibilities and cover arrangements
Premises evidenceThe organisation can lawfully use and operate from the office
Specialist evidencePositive behaviour support, restraint and Right support evidence where applicable

Supporting documents for a CQC variation application are not automatically defined by CQC’s new provider lists. They are still a useful readiness benchmark for a supported living service. Keep the evidence available and submit only what the current form and CQC instructions ask you to send.

How Long a CQC Variation Can Take

For a CQC variation application to add an activity, CQC asks providers to apply at least 10 weeks before the proposed start. Its assessment guidance says registration assessments can take several months, particularly where interviews, further information or a site visit are required.

There is no published average that guarantees how long your own variation will take. Plan backwards from the desired launch and leave room for CQC questions.

Planning pointProvider action
4 to 6 months before launchCheck the certificate, activity, conditions, location and manager route
Around 3 months before launchFinalise the Statement of Purpose, policies, contracts, training and management plan
At least 10 weeks before launchSend the connected provider and manager applications on current forms
During assessmentRespond promptly and keep supporting evidence ready
After approvalCheck the updated certificate before the service starts

Do not build a tender mobilisation date around an assumed approval. Commissioners may ask for evidence that your registration covers the correct activity, location and service user group before award or mobilisation.

Common Reasons CQC Variation Applications Are Returned

Avoidable errors usually arise because the documents describe different changes.

ProblemWhy it mattersCheck before sending
Old formCQC may return an outdated applicationDownload each form from CQC when the pack is ready
Certificate details copied incorrectlyThe application cannot be matched cleanly to the registrationCopy legal names, IDs, addresses and conditions exactly
Wrong routeThe provider applies for an activity it already holds or misses a location changeComplete the route decision before opening a form
Missing manager applicationProvider and manager conditions would not alignSubmit connected applications together
Missing updated Statement of PurposeThe proposed service is not described in the core registration documentInclude the revised controlled copy where required
Service user bands do not matchThe stated specialisms conflict across documentsReconcile every form, policy and training plan
Learning disability or autism condition overlookedThe proposed service may breach an existing conditionRead the full certificate before tendering or accepting referrals
Unrealistic start dateThe organisation may commit to care before approvalUse a conditional mobilisation plan

Before sending, run one final comparison across the certificate, provider form, manager form and Statement of Purpose. One mismatch can affect every linked application.

What You Must Not Do Before Approval

Do not provide a new regulated activity until CQC has approved the application and updated your registration. Do not operate from a new location until the location application has been granted. Do not provide a specialist learning disability or autism service whilst a condition on your certificate prohibits it.

Section 10 of the Health and Social Care Act 2008 makes carrying on a regulated activity without registration an offence. CQC also says changes covered by a registration condition must not take effect before approval.

You can prepare whilst the application is assessed. Recruit and train staff, complete policies, test systems, prepare accessible information and speak to commissioners. Contracts and mobilisation plans should remain conditional on the correct registration being in place.

How Care Sync Experts Supports CQC Variations

Care Sync Experts helps registered providers identify the correct change route before forms are completed. Support can include reviewing the existing certificate, preparing provider and manager forms, updating the Statement of Purpose, developing supported living policies and preparing evidence for learning disability and autism services.

We also help providers test whether the documents tell one consistent story. The activity, location, people supported, manager capacity, training plan and housing arrangements should all describe the same service.

Final Thoughts

A CQC variation application is easier to control when you begin with the certificate rather than the form. Confirm what activities and locations are already registered, check every condition, then decide whether the change needs a notification, a new activity application, a location application or a condition variation.

For supported living, the central questions are whether you already hold personal care, whether the managing office is registered for it and whether a learning disability or autism condition applies. Keep provider and manager applications aligned, update the Statement of Purpose and do not begin the change before the correct approval is in place.

FAQ

Do I need a new CQC registration to add supported living?

Usually, an existing provider does not need an entirely new provider registration. If you already hold personal care at the office that will manage the service, our reading of CQC guidance is that you may only need to update your Statement of Purpose and notify CQC. Confirm this with CQC before starting. A formal application is needed if you are adding personal care, opening a new registered location or asking CQC to remove a condition that prevents the proposed specialist service.

How long does it take to add a regulated activity to CQC registration?

CQC asks providers to submit an add activity application at least 10 weeks before the proposed start date. Its assessment guidance says the process can take several months, but it does not publish an average that guarantees an outcome date for a variation. The timing depends on the application, the evidence required and whether CQC needs further information, interviews or a visit. Build a realistic mobilisation plan and do not promise a service start before approval.

Can a domiciliary care provider offer supported living?

Yes, a domiciliary care provider can also operate supported living if its registration and operating model cover the care being delivered. Personal care is the regulated activity commonly shared by both service types. Check that the managing office is registered for the activity, update the Statement of Purpose and review any learning disability or autism condition. The tenancy and care arrangements must also remain genuinely separate so that the supported living model does not operate as accommodation with personal care.

Can I start the new service while CQC assesses the variation?

No, not where the change requires approval. CQC says you must not provide a new regulated activity until the application is approved and the registration is updated. You must also wait before operating from a new location or making a change prohibited by a current condition. You can recruit, train, prepare policies and speak to commissioners during assessment, but care delivery and contractual mobilisation should remain conditional on the correct registration being granted.
