What is Care Inspectorate Wales and Why Is Registration Essential?

Care Inspectorate Wales (CIW) is the independent regulator of social care and childcare services in Wales. Legal Framework: RISCA 2016 and Social Services and Well-being Act 2014

The authority and remit of Care Inspectorate Wales are established through two key pieces of Welsh legislation that form the backbone of social care regulation in Wales.

Regulation and Inspection of Social Care (Wales) Act 2016 (RISCA)

RISCA 2016 is the primary legislation governing social care regulation in Wales. This Act established CIW as an independent regulator and set out the legal framework for registering and inspecting social care services. RISCA replaced the Care Standards Act 2000 for Wales and introduced a more modern, outcomes-focused regulatory approach.

Types of Services Regulated by Care Inspectorate Wales

CIW regulates a diverse range of social care and childcare services across Wales. All providers operating these services must register with CIW and comply with the regulatory framework.

Domiciliary Support Services

Domiciliary support services provide personal care and support in the service user's own home. These services include assistance with personal hygiene, medication management, meal preparation, and support with daily living activities. Providers of domiciliary support services must be registered with CIW, and their staff must meet training and qualification requirements set out in the CIW regulations.

Care Home Services

Care homes provide accommodation and personal care for adults, including older adults, younger adults with disabilities, and other vulnerable adults. CIW regulates both residential care homes and nursing care homes. Care home providers must meet stringent requirements regarding staffing levels, training, record-keeping, and safeguarding protocols.

Secure Accommodation Services

Secure accommodation is provided for children and young people who are at risk of harm due to their own behaviour or vulnerability. These services are strictly regulated and must meet enhanced standards relating to risk management, safeguarding, and restraint procedures.

Residential Family Centre Services

Residential family centres provide accommodation and care for families with children who require intensive support. These services are often provided as part of child protection or family support interventions.

Adoption Services

Approved adoption agencies provide services to support the adoption process, including assessment, training, matching, and post-adoption support. All adoption agencies operating in Wales must be registered with CIW.

Fostering Services

Fostering agencies recruit, assess, train, and support foster carers. These services play a vital role in finding safe, nurturing family placements for children who cannot remain in their own homes.

Adult Placement Services

The Care Inspectorate Wales Registration Process

Before a social care or childcare service can legally operate in Wales, it must apply for and obtain registration with CIW. The registration process is designed to ensure that service providers meet essential legal and quality standards from the outset.

    Applicants must submit a registration application through CIW's online portal or via paper form, depending on the service type. Domiciliary services, for example, have lower fees than residential care homes due to differences in regulatory complexity. Fee information and band classifications are published on the CIW website and should be confirmed before submitting an application.

The Responsible Individual: A Cornerstone of CIW Regulation

One of the most significant changes introduced by RISCA was the requirement for all registered social care services to appoint a Responsible Individual (RI). The RI plays a crucial supervisory and accountability role within the service.

Who Can Be a Responsible Individual?

The RI must be an individual who is fit to hold the position. They cannot be a corporate body or partnership. The RI may be an owner, director, manager, or other senior figure within the organisation, depending on the service structure. Fit person requirements include:

  • Integrity, reliability, and competence necessary to ensure compliance
  • No relevant criminal convictions
  • Knowledge and understanding of Health and Social Care Standards
  • Significant experience in social care
  • Formal qualifications in social care or related fields

Responsible Individual Duties and Oversight

The RI is responsible for ensuring that the service complies with all regulatory requirements. Key duties include:

  • Reviewing the quality of care provided
  • Monitoring compliance with regulations
  • Taking corrective action when necessary
  • Conducting quarterly quality assurance visits and maintaining detailed records
  • Ensuring notifiable events are reported to CIW without delay
  • Ensuring annual returns and self-assessments are submitted on time

Given the breadth of the RI's responsibilities, many larger organisations appoint dedicated compliance officers to support the RI in fulfilling these duties.

Service Manager Requirements

In addition to the Responsible Individual, registered services must appoint a Service Manager who is responsible for the day-to-day running of the service. The Service Manager is directly accountable for implementing policies, managing staff, and ensuring that care standards are maintained. Unlike the RI, the Service Manager is typically involved in operational management and has frequent direct contact with service users and staff.

Service Manager Role and Responsibilities

The Service Manager must be competent in their role and capable of managing the service effectively. Key responsibilities include implementing CIW approved policies and procedures, managing and supervising staff, ensuring that care is provided in accordance with service users' support plans, maintaining comprehensive records, and escalating concerns or incidents appropriately. The Service Manager is also responsible for supporting the RI by providing information about the service's operations and quality metrics.

Service Manager Qualifications

CIW expects Service Managers to have formal qualifications and experience appropriate to the service type. For domiciliary care services, the CIW expects the Service Manager to hold a Level 3 or higher qualification in health and social care (such as the Diploma in Health and Social Care). For residential services, managers should typically hold a Level 4 or Level 5 qualification. Additionally, managers should have several years of relevant experience in social care management or a related field.

Disclosure and Barring Service (DBS) Checks

Both the Responsible Individual and Service Manager must undergo an enhanced DBS check before taking on their roles. DBS checks are criminal record checks that identify whether individuals have convictions, cautions, or other matters that might affect their suitability for roles working with vulnerable people. All staff employed in regulated services must also undergo DBS checks and other vetting procedures as required by the service type.

CIW conducts inspections of registered services to assess compliance with regulations and quality standards. The inspection framework is outcome-focused and examines how well services safeguard and support service users.

How Inspections Work in Wales

CIW conducts scheduled inspections of all registered services on a risk-based schedule. Services rated as performing well may be inspected less frequently, whilst those with identified concerns may receive more frequent inspections. Inspection teams typically include CIW inspectors with relevant expertise in social care. Inspectors may observe service delivery, interview staff and service users, review records, and assess the quality of care being provided. At the end of an inspection, CIW issues an inspection report which includes findings and a rating.

What Inspectors Look For

Inspectors assess a range of factors including the safety and well-being of service users, whether care and support is personalised and responsive, whether staffing levels are adequate, whether staff are properly trained and supervised, whether policies and procedures are followed, and whether the governance and management of the service are robust. Inspectors also examine whether services are responsive to complaints and how well leaders engage with service users and families.

Quality of Care Reviews and Self-Assessment

Alongside inspections, CIW requires services to conduct rigorous self-assessment and quality review activities. These mechanisms ensure that services maintain continuous improvement and address issues before they escalate.

Annual Self-Assessment Requirements

All registered services must complete an annual self-assessment, which is a comprehensive evaluation of the service against CIW regulations and Health and Social Care Standards. The self-assessment process should involve staff, service users, and families and should identify areas of strength and areas for improvement. The completed self-assessment is submitted to CIW annually and informs the regulator's risk assessment for inspection scheduling.

Responsible Individual Quarterly Visits

The RI must conduct at least quarterly quality assurance visits to the service. During these visits, the RI should review care records, interview staff and service users, observe service delivery, and assess compliance with regulations. The RI must document their findings and any issues identified, and must ensure that corrective actions are implemented. These quarterly visits provide a mechanism for continuous oversight and help prevent quality concerns from going undetected.

The Welsh Language Active Offer

Welsh language provision is an important aspect of social care in Wales, and CIW regulations require services to demonstrate awareness and responsiveness to Welsh language needs.

Understanding the Active Offer

The Active Offer in relation to Welsh language provision means that services must actively offer and promote the use of Welsh language services, rather than waiting for service users to request them. This reflects the principle of linguistic equality and ensures that Welsh-speaking service users are not disadvantaged in accessing care. Services must identify and plan for Welsh language provision based on the needs and preferences of their service users.

The Welsh Government guidance framework “Mwy na Geiriau” (More than Just Words) sets out the expectations for Welsh language services in health and social care. The framework requires organisations to assess Welsh language needs, engage with Welsh speakers, and plan services accordingly. For care providers, this may mean ensuring that staff speak Welsh, providing Welsh language materials and resources, and engaging with Welsh language communities. CIW expects providers to be working towards the principles of the Active Offer and to demonstrate progress.

Registered services must notify CIW of certain significant events without delay, usually within one working day.

Notifiable events include allegations of abuse or harm to service users, serious injuries to service users, deaths of service users, serious or repeated complaints, any prosecution of the service or its staff, changes in the Responsible Individual, serious breaches of regulations, threats to the continuity of service, and financial difficulties that could affect service delivery. Services must have clear procedures for identifying and reporting notifiable events and should ensure that staff understand what constitutes a notifiable event.

Annual Returns and Regulatory Submissions

Services must submit annual returns to CIW providing key operational data and compliance information. Annual returns include information about staffing, service capacity, complaints, incidents, and self-assessment findings. These returns are used by CIW to monitor service performance and inform inspection planning.

RQIA is the independent regulator for social care and health services in Northern Ireland. Northern Irish services should comply with RQIA requirements, not CIW requirements.
