The Care Quality Commission (CQC) has identified medicines management as a key area of regulatory inspection, and providers that fail to implement robust systems face enforcement action, conditions on registration, or service closure. This guide explains what CQC expects, how to build compliant systems, and how to learn from incidents.

What Is Medicines Management?

Medicines management encompasses every aspect of how medicines are handled in your service, from ordering and storage through to administration, monitoring for side effects, and disposal of unused or out-of-date medicines. It is not simply about handing someone a tablet; it involves multiple steps, multiple people, and detailed record-keeping.

In the context of social care, medicines management covers five main activities: prescribing (by GPs or other prescribers); dispensing (by pharmacies); administration (by care staff); monitoring (for effectiveness and side effects); and disposal (of unused medicines). Care providers are directly involved in the last three of these.

Effective medicines management requires:

  • Clear policies and procedures that reflect current legislation and best practice
  • Staff trained and competent in medicines administration and records management
  • Robust systems for ordering, receiving, and checking medicines
  • Secure storage with appropriate temperature monitoring for certain medicines
  • Accurate, contemporaneous records of all medicines given
  • Systems to identify and report medication errors
  • Regular review and audit of medicines management practice

The Legal Framework for Medicines Management

Medicines management is governed by several pieces of legislation. Understanding these is essential for CQC compliance.

Evidence Requirements

Staff must gather evidence that demonstrates they have achieved each standard. This evidence can include written work, observations of practice, reflective accounts, witness testimonies, and questioning. The combination of evidence methods ensures a thorough assessment of knowledge, understanding, and competence.

Regulation 12: Safe Care and Treatment

Regulation 12 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 requires providers to do everything practicable to ensure that medicines are obtained, stored, dispensed and administered safely. This regulation is one of the fundamental standards and a breach can lead to immediate enforcement action.

CQC Guidance on Medicines Management

The CQC has published specific guidance for domiciliary and supported living providers on medicines management. This guidance clarifies what CQC expects to see during inspection and what constitutes a breach of Regulation 12.

NICE Guidelines for Medicines Management

The National Institute for Health and Care Excellence (NICE) publishes guidance on medicines management in care homes and community settings. Specifically, NICE guidance NG96 on medicines optimisation and SC1 on managing medicines in care settings provide evidence-based recommendations for best practice.

Key NICE recommendations include:

  • Regular medicines reviews with the person, their GP, and pharmacy to ensure medicines are still appropriate
  • Clear communication with service users and their families about their medicines
  • Systems to prevent and identify medication errors
  • Training for all staff involved in medicines management
  • Protocols for administering medicines to ensure the right person receives the right medicine at the right time

Levels of Medicines Support

Not all care providers administer medicines directly. Some support people to manage their own medicines. It is important to understand the different levels of support, as each has different legal and regulatory implications.

Level 1

Prompting

Prompting means reminding a person that it is time for their medicine, but the person administers the medicine themselves. This does not count as administration by the care worker, so your service does not need to hold controlled drugs licences for prompting alone. However, you should still keep records of whether the person took their prompted dose.

Level 2

Assisting

Assisting means helping someone to take their medicine, for example, opening the medicine bottle or crushing tablets if appropriate. The person still takes the medicine themselves, but you are providing hands-on help. Again, this is not administration in the legal sense, but you should keep records.

Level 3

Administering

Administration means you actually give the medicine to the person. This includes placing a tablet in their mouth, administering an injection, applying a topical cream, or giving medicines via feeding tubes. This is the level that triggers full regulatory requirements for storage, records, staff competency, and in the case of controlled drugs, specific licences.

Level 4

Covert Administration

Covert administration means giving someone medicines hidden in food or drink without their knowledge. This is only permissible in very specific circumstances with evidence of legal authority (such as a Court of Protection order or agreed best interests procedures). Covert administration is a sensitive area; CQC inspectors routinely ask about your covert administration policy, and there must be clear governance and recorded decision-making. For most services, covert administration should be extremely rare and only used as a last resort.

MAR Charts: Medication Administration Records

Medication Administration Records (MAR charts) are the cornerstone of safe medicines management. They provide contemporaneous, written evidence that medicines have been given, and they allow you to identify patterns and problems.

What a MAR Chart Must Include

  • Service user name and date of birth
  • The name of each medicine prescribed
  • The dose and frequency
  • The route of administration (oral, injection, topical, etc)
  • Any allergies or intolerances
  • The date and time the medicine was given
  • The name and initials of the staff member who gave the medicine
  • Any reasons the medicine was not given (refusal, missed dose, etc)
  • Any side effects or concerns noted

Common MAR Chart Errors

  • Pre-signing or pre-dating MAR charts
  • Completing MAR charts in retrospective batches rather than at the time of administration
  • Using non-specific codes or abbreviations that are not explained
  • Altering or crossing out entries without proper authorisation or amendment signature
  • Not recording reasons for missed or refused doses
  • Failing to record side effects or concerns

MAR Chart Best Practice

  • Complete the MAR chart immediately after administering the medicine
  • Use clear, unambiguous codes and explain any abbreviations
  • If an error is made, draw a single line through the error and initial and date the correction
  • Record the reason for any missing or refused doses
  • Review the MAR chart regularly for patterns or concerns
  • Reconcile the MAR chart with the prescribed medicines monthly to ensure accuracy

Medicines Storage and Handling

General Storage Requirements

All medicines should be:

  • Stored in a secure, locked cabinet or room to which only authorised staff have access
  • Stored at the appropriate temperature; some medicines require cool conditions
  • Kept in original, labelled containers
  • Stored away from moisture, excessive heat, or light unless otherwise specified
  • Stored separately from other chemicals or cleaning products

Controlled Drugs

Controlled drugs, such as morphine, codeine, benzodiazepines, and some ADHD medications, have additional requirements. These medicines must be:

  • Recorded in a controlled drugs register with details of who held them, when they were received, and when they were administered
  • Checked regularly, particularly if multiple staff members have access
  • Disposed of through a pharmacy or authorised waste disposal service

Services administering controlled drugs must hold a licence from the relevant local authority. CQC will verify that you hold the necessary licences and that your storage and record-keeping meet the standards.

Temperature Monitoring

Some medicines, such as insulin, must be stored in a refrigerator at a specific temperature range (typically 2 to 8 degrees Celsius). You should:

  • Use a thermometer to monitor and record fridge temperatures daily
  • Have a backup plan if the fridge fails (such as an ice box or alternative storage)
  • Keep records of temperature checks
  • Report any temperature excursions immediately and note whether affected medicines are still safe to use

Disposal of Medicines

Expired or unused medicines should never be flushed down the toilet or disposed of in household waste, as they can contaminate water supplies. Instead:

  • Return unwanted medicines to a community pharmacy, which will dispose of them safely free of charge
  • Keep records of when medicines are returned to pharmacy
  • Do not store medicines beyond their expiry date

Staff Competency and Training

CQC expects all staff involved in medicines administration to be trained and competent. This is not a one-off requirement; it is ongoing.

Who Can Administer Medicines?

In care settings, medicines can only be administered by:

  • Registered nurses
  • Care workers (with appropriate training and competency assessment)
  • The person themselves (self-administration)

Care workers administering medicines must be assessed as competent by a registered nurse or experienced senior care worker. This assessment should cover:

  • Understanding of relevant medicines and their effects
  • Ability to read and interpret prescriptions and MAR charts
  • Safe administration technique
  • Record-keeping
  • Recognition of side effects and adverse reactions
  • What to do if a dose is missed or refused

Training Requirements

All care staff should receive:

  • Initial induction training on your medicines management procedures before they administer any medicines
  • Annual medicines management training to refresh knowledge
  • Specialist training depending on service user needs, such as training in insulin administration or use of asthma inhalers
  • Training on recognising and reporting medication errors and adverse reactions

Records of all training should be kept, including training dates, topics covered, and assessor details.

Medication Errors and Incident Reporting

A medication error is any mistake in the prescribing, dispensing, or administration of a medicine. Even if no harm occurs, the error must be recorded and reported.

How to Identify Medication Errors

Medication errors include:

  • Giving the wrong medicine
  • Giving the right medicine to the wrong person
  • Giving the medicine at the wrong time
  • Giving the wrong dose
  • Giving the medicine by the wrong route (for example, orally instead of by injection)
  • Omitting a prescribed medicine
  • Giving a medicine to which the person is known to be allergic

What to Do If a Medication Error Occurs

  • Stop and assess the immediate situation; check whether the person has experienced any ill effects
  • Notify a registered healthcare professional (GP, nurse, pharmacist) immediately for advice
  • Document the error in detail: what happened, when it happened, who was involved, what action was taken
  • Notify the service user and their family or representative
  • Report the error through your incident reporting system
  • Investigate the error; what system failure allowed it to happen?
  • Implement changes to prevent the error recurring

Learning from Incidents

Incidents are learning opportunities. After each medication error, your service should:

  • Conduct a root cause analysis to identify why the error occurred
  • Identify whether the error was due to human factors (fatigue, distraction), system factors (unclear procedures, poor labelling), or a combination
  • Make changes to systems, training, or procedures to reduce the risk of recurrence
  • Share the learning with all staff so others can benefit from the experience
CQC inspectors will ask about medication errors and your duty of candour obligations, which require you to be open and honest about errors and to notify and apologise to the affected person.

CQC Inspection and Medicines Management

During a CQC inspection, inspectors will routinely examine your medicines management systems. Here is what they look for:

Documentation and Records

Inspectors will examine:

  • MAR charts for multiple service users across a date range
  • Controlled drugs registers if applicable
  • Temperature monitoring records
  • Medicines management policies and procedures
  • Records of staff training and competency assessments
  • Incident reports and investigations relating to medication errors

The Physical Environment

Inspectors will observe:

  • Whether medicines are stored securely in locked cabinets or rooms
  • Whether controlled drugs cabinets meet specifications
  • Whether fridges are functioning correctly and temperatures are being monitored
  • Whether unused medicines are being stored appropriately
  • Whether the environment is clean and free from contamination

Speaking with Staff and Service Users

Inspectors will:

  • Ask staff about the medicines they administer and whether they have been trained
  • Observe staff administering medicines if possible
  • Ask service users whether they receive their medicines as expected
  • Ask staff how they respond to medication errors

Common CQC Inspection Findings

The most commonly identified issues are:

  • Incomplete or inaccurate MAR charts
  • Evidence of pre-signing or retrospective completion of MAR charts
  • Staff without current training or competency assessment
  • Insecure storage of medicines
  • Failure to monitor and record fridge temperatures
  • No documented procedure for reporting medication errors
  • Expired medicines not disposed of correctly
  • Lack of clarity about levels of support and who is responsible for administration
